California is a community property state. Community Property is defined as the earnings of both parties and property acquired with those earnings during marriage with the exception of gifts and inheritance. Community property is to be divided roughly 50-50, i.e. husband and wife should both receive roughly one-half (1/2) of the community property. In contrast, separate property belongs to the party who acquired and/or earned that separate property.
