It is often advantageous to either or both parties, either prior to being married and/or after being married, to have a prenuptial and/or postnuptial agreement prepared. The prenuptial agreement typically covers three subject matters, i.e. whether or not separate property will remain separate properly during the marriage whether or not earning during the marriage will be community or separate property, and whether or not the parties wish to waive spousal support in the event of a marital dissolution. The postnuptial agreement can deal with these three factors and others. While we still prepare prenuptial and postnuptial agreements, because of the post-Barry Bonds legislation enacted several years ago, we do have certain conditions precedent to our involvement. | |
